No, this is not a new law in Makati City. Nor is it specific to counter the popularity of social media. It is simply the modern application of an ordinance enacted in February 19, 2002 which is AN ORDINANCE PROHIBITING THE USE AND OPERATION OF CELLULAR TELEPHONES WITHIN A 30 METER RADIUS FROM FUEL PUMPS OF GASOLINE STATIONS LOCATED IN THE CITY OF MAKATI for safety reasons.
The City Council of Makati recognizes the possibility that the use and operation of cellular telephone units within 30-meter radius of gasoline stations, especially when refilling vehicles’ gasoline tanks, poses a threat to the safety of motorists, station employees and to the establishments themselves through the probability of igniting highly flammable fumes and materials by cellular telephones.
The same ordinance provides a penalty for the violation thereof.
While this is an old ordinance, it is good to remind people in this day and age of smartphones and social media on mobile devices that any person found in violation of the ordinance shall be liable for a fine not exceeding Two Thousand Pesos (P2,000.00), imprisonment of not more than two (2) days, or both fine and imprisonment at the discretion of the court.
